Likely since the news is spreading of such a device, it won't be "underground" anymore:
1. Nintendo will do their best to prevent the SC (and M3) from working with future game releases and future Nintendo DS's (this one is already happening)
2. International anti-pirate law enforcement will do their best to stop the SC shops from selling it

Oh I'm sure they knew about it.  They're not clueless.  
But thanks to those doofuses who put out the press release it's a lot more open/popular knowledgeable now.  
They'll likely introduce something in the carts to deter piracy.

Checking the domain name registration for the site, revealed that the name servers are based in the U.K. but the identities of the owners are protected by WhoisGuard.

Meaning what exactly? nameservers tell you nothing about where a site is hosted.
