As was mentioned earlier, downloading games whether you have the originals or not is moot because that's still considered illegal. You have to have backups of YOUR software/movies. The irony being that nearly all game software and movies have protections on them that make it hard or impossible for the average person to make true working backups of things they own as they are legally entitled to.

You're legally entitled to make and own a backup, and the movie and game industry are entitled to make it as hard as possible to do to protect their copyrights... The american legal system at it's finest.

As for receiving letters from ISPs, I don't believe most if ANY ISPs will release personal information if someone comes to them. It's not so much a matter of wanting to protect the customers as a "we don't want to get sued for releasing personal information". The ISP themselves can't be sued by anyone because of the actions of the customers, instead whoever is bringing the lawsuit has to go to court to try and get the records... something that has been historically hard to do, and very costly. That's why the RIAA hasn't continued sueing individuals like they did in the late 90's early 00's. They wanted to make a point that they are heartless bastards that are willing to sue 12 year old girls that don't know better... but not much has come of it sense because in the end, they are a business and businesses only care about making money and wasting millions of dollars on court cases that even if they win won't net them much money isn't worth it.
