A Concern of Mine...

I was concerned that when Nintendo release online capabilities, it'll require a firmware patch and that the firmware patch would almost certain contain code to stop the PassMe functioning. Am I just being paranoid, or is this a possibility?

You're being paranoid. nintendo probably won't want to update the firmwear, thats a nasty sony trick.

One thing that does worry me about online, is nintendo may be able to see if you're using a rom and not the actual game. Do you think that's possible?

Well, I can understand albrowne's fear...as Nintendo has said that they're going to use a centralized-server service (I believe with GameSpy...though I may be wrong) to connect users of games via WiFi.

Catch with WiFi is you'll need to implement a TCP/IP stack, and provide some means in order to connect to an access point (and specify what AP to connect to) as well as setting WEP / WPA settings.

While it is possible that they will include the server browser, IP stack, and WiFi connection utility in each cart, it seems kind of silly...
...I do kinda think, from an amature programmer's perpective, that we may see a firmware update to implement these features.
However, I do not forsee this process being something akin to FlashMe...there's just no way they'll have their userbase shorting a connection on the circuit board in order to add these features.

...but really, only time will tell.
