their "innovation" is insufficiently novel to constitute a winner. As the article notes, Nintendo already had a trigger button in that position on the middle prong of its N64 controller 10 years ago. (the Z button) Do I smell countersuit????

N will win, they had a trigger on the N64 as it was pointed out. They wont take the time to counter sue and expect more lawsuits, every is gonna want a part of Nintendo's big Wii pie.

The basis for Nintendo's alleged infringement is:

Interlink's "loss of reasonable royalties, reduced sales and/or lost profits as a result of the infringing activities."

How could Inerlink lose royalties or sales as a result of Nintendo having a button on the bottom of their controller?  It's completely baseless.

Altor: I was thinking the same thing when I originally read it. I don't think they'll be able to prove that they've lost sales or profits since they weren't in any way competing with nintendo with their system. The only substantial claim then would be the reasonable royalties, but that doesn't hold water as Nintendo has a history of having similar button configurations on their past controllers.

Which is why nintendo can probably countersue.

I just hope they don't loose. I know It's unlikly, but If nintendo starts loosing a substantial amount of money for any reason, I'm probably going to start feeling guilty about me pirating nds games. I mean, the only reason I do it is because I think "Nintendo makes tons of money, they really don't need more." but If that stops happening... I'm in trouble.

That's really the wrong attitude to have anyways...

I still buy really good DS games, I just don't like paying $40 for a game I'll only play 30 minutes before getting bored. Plus homebrew = love.

How many times is the wii going to get Nintendo sued? Even when a company wins a lawsuit, they still have spent $$ on expensive layers, so any lawsuit is hurtful.
