becouse the game generate a code mixig it unique code and the MAC adress of the DS.. and this number you have to post on the site of Nintendo wifi ..

so Nintendo HAS ways to know who is using roms to play!!  becouse the Unique code is not unique anymore!

and Ban the mac adresss form the network!

I'm not sure exactly how it works.. but I think that the code is generated with the mac adress (which is per DS) combined with the code, so theoretically you'll never be able to get the same code twice, nomatter the cart's code, because all mac adresses are different.  I'm not 100% sure on that though.

Really the only fault I can find with my theory is if the servers call up the game's specific ID as well as the game code, than it wouldn't work, sort of like PC games w/ multiple CD Keys.  We'll just have to wait and see I suppose.

I won't have to worry about this since I plan on buying the real thing, but there may be other online games that I'd like to play but not necessarily buy in the future so I'm going to watch this closely. I find it very hard to believe that nintendo wouldn't have some way of detecting identical games, but I can also see how nintendo would shy away from multiplayer keys like PC games use since they are a kids company and it'd be fairly easy for a child to lose something like that.

Also, on the subject of Romman, he said just a few days ago that he'd have the new firmware and software out sometime in the middle of november. We aren't out of the middle of November yet so I'm not worried.
