homebrew is greyware (its somewhat legal but can be illegal) but they updated thier stuff because with homebrew comes piracy of games which is why nintendo updated thier stuff.
and sony with thier 1/2 billion updates of their firmware as well.

It's like downloading music and movies, it's convienient and easy. Also, it unlocks whole new things that normal DS's cannot do, you can go on MSN or AIM, or email. So many people are homebrewing that they don't really care. It is like how they can't catch you for downloading music. Although they could bust the people who make it, you are safe...

I always thought that homebrew was completely legal, the adapters are completely legal as long as you don't run roms. Flashme is perfectly legal because once you buy the DS Lite, you can do whatever you want. The homebrew programsare completely legal unless the programmer of that program set limits. ROMs are obviously illegal for obvious reasons.

it depends on the laws and everything, but modifing the firmware of most consoles is now illegal in the us, and also modchips and flash cartridges are greyware meaning they are legal but only when used in a certain fashion that most of the time its not used in.
